Event Terms and Conditions 

Please read these Terms and Conditions ("Agreement") carefully before using the services provided by Localise You (“Host”, "We," "Us," or "Our"). This Agreement sets forth the terms and conditions governing your participation in events organised by us as a business. By participating in our events, you agree to be bound by this Agreement. 

1. Event Participation: 

1.1 Eligibility: Participation in our events addressed to but limited to our clients and their authorised representatives. By participating, you represent and warrant that you have the authority to enter into this Agreement on behalf of your organisation. 

1.2 Registration: To participate in our events, you may be required to complete the registration process, provide accurate and up-to-date information, and agree to any additional event-specific terms or requirements. 

1.3 Event Changes: We reserve the right to make changes to event schedules, programs, venues, speakers, and other event details. We will make reasonable efforts to notify registered participants of any significant changes or cancellations. 

2. Payment and Fees: 

2.1 Payment Obligations: Participation in our events may require payment of registration fees, sponsorship fees, or other charges as specified in the event information. All payments are non-refundable unless otherwise stated as per our ‘Cancellation Policy’. 

2.2 Payment Terms: Payment must be made by the specified due date on provided invoice or online booking system. Failure to make timely payment may result in the cancellation of your participation without liability to us. 

2.3 Taxes and Expenses: You are responsible for any applicable taxes, customs duties, or other expenses associated with your participation in our events, unless otherwise indicated. 

3. Event Conduct: 

3.1 Compliance: Participants must comply with all applicable laws, regulations, and venue rules during our events. We reserve the right to refuse entry or remove any participant who violates this Agreement or engages in disruptive or inappropriate behaviour. 

3.2 Intellectual Property: All intellectual property rights, including copyrights, trademarks, and proprietary materials, related to our events and associated content are owned by us or our licensors. Participants may not reproduce, distribute, or use any event-related materials without our prior written consent. 

3.3 Networking and Communication: Our events may provide networking opportunities with other participants, sponsors, or exhibitors. You agree to engage in respectful and professional communication and networking activities. 

3.4 Dietary requirements must be advised at the time of booking and no later than five (5) calendar days prior to the event. By agreeing to these terms and conditions, the Purchaser acknowledges that failure to provide such notice may result in a meal being served that does not meet their dietary requirements and we accept no liability.

3.5 The use of cameras, audio and video recorders is at the discretion of the Host and may not be permitted at an event. The Host reserves the right to broadcast and/or telecast any event and take photos for marketing and publication.

4. Limitation of Liability: 

4.1. The participant(s) hereby acknowledge and understand that participation in the events and bus tour organised by Localise You involves certain risks and hazards. The participant(s) voluntarily assume all such risks and hereby agree to release, indemnify, and hold harmless Localise You, its officers, employees, agents, and representatives from any and all claims, demands, actions, causes of action, or liabilities arising out of or related to their participation in the tour. 

4.2. The participant(s) agree to indemnify Localise You and its representatives against any loss, liability, damage, costs, or expenses (including legal fees) incurred by Localise You as a result of any claims, demands, actions, causes of action, or liabilities arising out of or related to the participant(s)’ participation in the events and bus tour, including but not limited to personal injuries, property damage, or any other loss suffered by the participant(s) or any third party. 

4.3. The participant(s) understand that Localise You will take reasonable measures to ensure the safety and security of the events and bus tour. However, Localise You shall not be liable for any loss, injury, damage, or expense incurred by the participant(s) arising from any act or omission of any third party, including but not limited to transportation providers, venue owners, or other participants. 

4. 4 The participant(s) acknowledge that Localise You does not provide any insurance coverage for the events and bus tour. It is the responsibility of the participant(s) to obtain their own insurance coverage for any loss, injury, or damage that may occur during the events and bus tour. 

4.5 The participant(s) agree to comply with all instructions, rules, regulations, and guidelines provided by Localise You and other third-party vendors before and during the event and bus tour. Failure to comply with these instructions may result in the participant(s) being excluded from the tour without any entitlement to a refund. 

4.6 This indemnity clause shall be binding upon the participant(s) and their respective heirs, executors, administrators, successors, and assigns. 

4.7 Disclaimer: We make no warranties or representations regarding the accuracy, completeness, or suitability of the information provided during our events. Participation in our events is at your own risk, and we disclaim all liability for any damages, losses, or injuries arising from your participation. 

4.8 Indemnification: You agree to indemnify, defend, and hold us harmless from any claims, demands, liabilities, damages, or expenses (including legal fees) arising out of or related to your participation in our events or your breach of this Agreement. 

5. Confidentiality: 

5.1 Confidential Information: During our events, you may be exposed to confidential or proprietary information shared by other participants, sponsors, or exhibitors. You agree to

treat such information as confidential and not disclose or use it for any purpose other than the event-related activities. 

6 Cancellation and Refund Policy 

6.1 Cancellation by the Host In the circumstance that an event to be held by Localise You is cancelled by the Host for any reason, all amounts paid by a Purchaser, less any surcharge for the use of certain credit cards, can be used by the Purchaser as a credit toward a future event or will be refunded by the Host to the Purchaser. 

6.2 Cancellation by the Purchaser In general, unless otherwise stated, event bookings are transferable and if a Purchaser is not able to attend, they may send another person in their place. Please note that prior notice of such a substitution must be provided to the Host (maryann@localiseyou.com.au), seven (7) calendar days in advance of the event. If a Purchaser is unable to attend or find someone to take their place, the following policy applies: 

1. Cancellations will only be accepted in writing, by email addressed to maryann@localiseyou.com.au 

2. For notice of cancellation received up to fourteen (14) calendar days prior to the event the Purchaser may choose to either – a. Apply the full amount, less any surcharge for use of credit cards for the initial purchase, of the purchase price to another Host event as long as such event falls within 4 months of the cancellation date. b. Receive a refund of the purchase price, less any surcharge for the use of credit cards for the initial purchase, also less an administrative fee of $50.00 per seat, including GST if applicable. 

3. For notice of cancellation received less than fourteen (14) calendar days prior to the event but up to seven (7) calendar days prior to the event, the Purchaser may apply the full amount, less any surcharge for use of credit cards for the initial purchase, of the purchase price to another Host event as long as such event falls within 4 months of the cancellation date. Refunds will not be issued. 

4. For notice of cancellation received less than seven (7) days prior to an event or not attending an event no refunds or credits will be given. 

7. Governing Law and Dispute Resolution: 

7.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. 

8. Miscellaneous: 

8.1 Entire Agreement: This Agreement constitutes the entire agreement between you and us concerning the subject matter herein and supersedes any prior or contemporaneous agreements, understandings, or representations.

8.2 Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

8.3 Waiver: The failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision or the right to enforce it. 

By participating in our events, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree with any part of this Agreement, please refrain from participating in our events.
